DynaTracker Licensing Agreement
DynaTracker.com, (a division of Dytanium), grants you an exclusive
license to use its software if you follow all restrictions in all
sections of this Agreement.
Important: DynaTracker is NOT an open source software product.
You must follow the limitations in this software agreement.
Although all copyrights visible to users via browser are no longer
required, all DynaTracker copyright notices contained in source files
therein must remain unchanged and visible within the said script.
Copyright notices contained therein must not be removed or altered
under any circumstances without the express permission of DynaTracker.com.
1) DynaTracker grants you the right to run one instance
(a single installation) of a program and or script per domain name
for each license purchased.
For each installed instance of a program/script, a separate license is required.
2) All customers must include the URL where DynaTracker will be used.
3) At the owners risk, anyone may alter programs/scripts, produced by
DynaTracker.com , but said programs/scripts, altered or otherwise,
may not be distributed to entities beyond the license holder without the
explicit written permission of DynaTracker.com.
Said modifications are at the risk of the owner/user and will not be
supported by DynaTracker.com
SCOPE OF GRANT
You may not:
Permit other individuals to use the Software except under the terms outlined
in this license agreement
Reverse engineer, disassemble, or create derivative works based on the
Software for distribution or usage outside your web site.
Use the Software in such as way as to condone or encourage terrorism,
promote or provide pirated software, or any other form of illegal or damaging activity.
Distribute the software without written consent from DynaTracker.com
Distribute or modify proprietary graphics, HTML, or CSS packaged with the
Software for use in other Software applications or web sites without written permission from
DynaTracker.com.
4) Registered users may modify the DynaTracker code for their personal use
(at their own risk), but any altered code must not be redistributed or resold in any form.
5) DynaTracker programs/scripts may not be used for anything that would
represent or is associated with an Intellectual Property Violation, including,
but not limited to, engaging in any activity that infringes or misappropriates the
intellectual property rights of others, including copyrights, trademarks,
service marks, trade secrets, software piracy, and patents held by individuals,
corporations, or other entities.
6) If any terms are violated, DynaTracker.com reserves the right to revoke
license's at any time. No license refunds will be granted for revoked licenses.
DynaTracker.com reserves the right to modify these terms at any time.
This license is governed by the International Copyright Laws.
7) License fees are non-refundable. We encourage you to verify that the
server which hosts your web site supports MySQL 3.23 or better and PHP 4.1.0
or better, before purchasing a program/script from DynaTracker.com.
THE LAW
Your acquisition and use of software is governed by international copyright
laws and the license agreement accompanying the software. Therefore,
you should be aware that it is a breach of the license agreement and it is illegal:
1)To copy or distribute software or its accompanying documentation, including programs,
applications, data, codes, and manuals, without permission or a license from the
copyright owner;
2)To run a copyrighted software program on two or more computers simultaneously
unless this is specifically allowed by the license agreement;
3)For organizations to consciously or unconsciously encourage, allow, compel, or
pressure employees to make or distribute unauthorized software copies;
4)To infringe the laws against unauthorized software copying because someone
requests or compels it;
5)To lend software so that a copy can be made or to copy software while it is lent to you;
6)To make, import, possess, or deal with articles intended to facilitate the removal
of any technical means applied to protect the software program.
Disclaimer of Warranty
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES
AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.
DynaTracker.com is not liable for the content contained or added to a program/script
as provided by DynaTracker.com
PROPRIETARY LABELS
Authorization to remove copyright notices is allowed for specified fees.
These fees authorize you to remove the output of copyright notices,
but it does not give you authorization to remove any copyright notices in
the script source header files nor any other rights.
What are the penalties for pirating software?
If caught with pirated software, the infringing company or individual may
be liable under both civil and criminal law. A civil action may be instituted for
injunctive relief, actual damages (including infringement profits), or statutory
damages up to $20,000 per infringement. Criminal penalties for copyright
infringement include fines up to $1,000,000 and jail terms up to five years, or both.
TITLE
Title, ownership rights, and intellectual property rights in the Software
shall remain with DynaTracker.com. The Software is protected by copyright laws
and treaties. Title and related rights in the content accessed through the
Software is the property of the applicable content owner and may be protected by
applicable law. This License gives you no rights to such content.
TERMINATION
This Agreement will terminate automatically if you fail to comply with the
limitations described herein. On termination, you must destroy all
copies of the Software within 48 hours.
MISCELLANEOUS
DynaTracker.com reserves the right to change the terms of this Agreement
at any time however those changes are not retroactive to past releases.
Technical support will not be provided for third-party modifications to the
Software including modifications to code. If the Software is modified using a
third-party modification instruction or otherwise, technical support may be
refused to any license holder.
